Most first applications are denied, and appeals are where many people win. Each step must be requested within 60 days of getting the decision letter (SSA assumes you got it 5 days after the date on it).

Key facts
- SSA generally must authorize a representative’s fee. Fee agreements and fee petitions follow different rules, and expenses may be separate. Review the written agreement and SSA’s representation guidance.
- Legal Aid of NC and Disability Rights NC may help for free.
- Keep going to treatment during the appeal. Gaps in treatment hurt the case.
Step by step
- Reconsideration: a new reviewer at DDS looks at the file. Ask online or with form SSA-561. Add any new medical records.
- Hearing: an Administrative Law Judge hears the case, often by phone or video. Ask with form HA-501. This is often the best chance to win.
- Appeals Council review: asks whether the judge made a mistake (HA-520).
- Federal court: the last step, usually with a lawyer.
- For a medical disability cessation, ask SSA immediately whether benefits can continue during appeal and what deadline applies. Other suspension or termination decisions follow different rules.
Common mistakes to avoid
- Starting a new application instead of appealing.
- Missing the 60-day deadline.
- Not sending updated records.
